All proposals to conduct clinical trials in Australia require ethical review and approval by a human research ethics committee. The clinical trial investigator is responsible for ensuring that the trial is conducted according to the agreed protocol, in accordance with the Health Authority approval and with regard to the guiding principle of protecting the rights, safety, and welfare of subjects under the investigator’s care in the trial. A patients’ eligibility and suitability to participate in a clinical trial are matters which must be assessed by a clinical trial investigator on a case by case basis.
